1. Scope and Acceptance

These Terms & Conditions ("Terms") govern all orders placed through the luppizblog online store ("we", "us", "our") by both consumers and business customers. By browsing our store, adding products to your cart, and completing an order, you agree to be bound by these Terms in their entirety. Please read them carefully before placing an order. If you do not agree with any part of these Terms, you should refrain from using our store or placing an order.

These Terms apply in addition to, and do not replace, any statutory rights you may have as a consumer under applicable law, including the mandatory consumer protection rules of Spain and, where applicable, the European Union.

3. Conclusion of the Contract

The product listings displayed in our online store do not constitute a legally binding offer to sell on our part. Instead, they represent an invitation for you to place an order ("invitatio ad offerendum"). When you click the order button at the end of the checkout process, you are submitting a binding offer to purchase the goods contained in your shopping cart.

Once we receive your order, we will send you an acknowledgement of receipt by email. This acknowledgement does not, by itself, constitute our acceptance of your order. A binding sales contract is only formed when we either send you a separate order acceptance email confirming that we accept your offer, or when we ship the ordered goods to you — whichever occurs first.

We reserve the right to decline an order, for example in cases of stock unavailability, pricing errors, or suspected fraudulent activity, in which case any payment already made will be refunded.

4. Prices and Shipping Costs

All prices displayed on our product pages are quoted in EUR and include statutory value-added tax (VAT) as well as any other mandatory price components applicable at the time of order. These prices do not necessarily include shipping costs.

Any applicable shipping costs are calculated and clearly displayed to you during the checkout process, before you complete and confirm your order. The total price you are charged, including shipping, will always be shown for your review prior to final order submission.

5. Payment

The payment methods available for your order are presented and selectable during the checkout process. Depending on the payment method chosen, additional terms provided by our payment service providers may apply.

Unless otherwise agreed between you and us, payment is due immediately upon conclusion of the contract as described in Section 3 above. If payment is not received, we reserve the right to withhold shipment of the ordered goods until payment has been confirmed.

6. Delivery

Unless a different delivery time is stated for a specific product at the time of order, we aim to ship your order within 3–7 working days of the conclusion of the contract or, where payment is required in advance, within 3–7 working days of receipt of your payment.

Please note that this timeframe refers to the dispatch of goods from our facilities and does not include the time required for the carrier to deliver the package to your address. Any delivery estimates provided by the carrier are separate from, and in addition to, the dispatch timeframe stated here.

7. Retention of Title

All goods supplied remain our property until they have been paid for in full. Until full payment has been received, you may not pledge, sell, or otherwise transfer the goods to a third party without our prior written consent.

8. Right of Withdrawal and Returns

If you are a consumer, you benefit from the statutory right of withdrawal applicable under Spanish and EU consumer protection law. This right allows you to cancel your purchase within the legally prescribed period without needing to provide a reason.

Full details on how to exercise this right, the applicable withdrawal period, the return process, and any conditions or exceptions that may apply are set out in our Right of Withdrawal policy, which forms part of these Terms. We recommend reviewing that policy before placing an order and again before initiating any return.

9. Warranty

All products sold through our store are covered by the statutory warranty rights afforded to consumers under applicable Spanish and EU law. These rights exist independently of, and are not limited by, any commercial guarantee that may be offered by a manufacturer.

If a product you receive is defective or does not conform to the contract, please contact us using the details in Section 2 so that we can assist you in accordance with your statutory warranty rights.

10. Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform for consumers who wish to resolve disputes relating to online purchases without going to court. The platform can be accessed at: https://ec.europa.eu/consumers/odr/.

While we make you aware of this platform in accordance with applicable disclosure obligations, we are not obligated, nor currently willing, to participate in dispute resolution proceedings before a consumer arbitration board.

11. Governing Law and Severability

These Terms, and any contract concluded through our store, are governed by the laws of Spain, without prejudice to any mandatory consumer protection provisions of the country in which you, as a consumer, have your habitual residence, where such provisions grant you greater protection.

Should any individual provision of these Terms be or become invalid, illegal, or unenforceable, this shall not affect the validity of the remaining provisions. The invalid provision shall be deemed replaced, to the extent legally possible, by a valid provision that most closely reflects the economic intent of the original.
